TERRA-MICHI Beta Terms of Use

Effective date: [October 20, 2026]

Article 1 — About these Terms

These Terms of Use set out the conditions for using the TERRA-MICHI beta and related services (the “Service”) provided by the operator of TERRA-MICHI, [the full legal name of the contracting entity is to be confirmed. Proposed identification: isVIT Co., Ltd. (Japan) / isVIT Co., Ltd. (Cambodia); referred to below as “we” or “us”].

Users must read and agree to these Terms before using the Service. Anyone using the Service for a company or organization must have the authority required to use it and enter the relevant data.

Article 2 — Purpose of the Service

The Service uses information such as terrain, elevation and land use to support understanding of existing site conditions, consideration of road, grading and regional plans, approximate earthwork calculations, and comparisons that take environmental impacts into account.

Available features, supported regions, usage limits and other conditions are described within the Service. Features under development or planned for release may differ from those actually available.

Article 3 — Beta status and fees

The Service is a beta version whose functionality and quality are being tested and improved. Bugs, calculation or display errors, processing delays, failures to save data and changes to specifications may occur.

Features described as free may be used free of charge. If paid plans or other paid services are introduced, their details and prices will be announced in advance. Users will not be charged automatically without applying for or agreeing to the paid service.

Article 4 — Registration and account management

Users must provide accurate registration information and update it when it changes.

Please safeguard authentication emails, authentication links and other account information to prevent unauthorized use by third parties. Contact us promptly if you suspect unauthorized use.

We may refuse registration or restrict use if we identify false registration information, unauthorized use, a serious breach of these Terms or similar conduct.

Article 5 — Use and verification of analysis results

Elevation, gradients, contour lines, cut-and-fill volumes, earthwork balance, rainwater flow, water accumulation tendencies, forest and ecosystem information, and AI suggestions displayed by the Service are reference information for planning.

They do not replace survey results, geotechnical investigations, structural or drainage calculations, environmental impact assessments, land-title investigations or decisions by public authorities.

Results may differ from actual site conditions because of the source data’s date, resolution or accuracy, calculation methods, input conditions or other factors. The absence of a protected area, rights information or disaster risk on the map does not mean that none exists.

Before using results for land acquisition, design, construction, permit applications or disaster prevention decisions, conduct site inspections and actual measurements, obtain professional review, and check applicable laws and requirements with the relevant authorities. Do not base decisions that may materially affect human life or property solely on the Service’s results.

Even where displayed values refer to standards used in Japan or another country, they do not guarantee legality or safety in the location concerned.

Article 6 — Rights in and handling of input data

Rights in drawings, planning parameters, geographic information, text, images and other data entered or saved by users belong to the users or other legitimate rights holders.

Users authorize us to store, reproduce, analyze, convert and display such data to the extent necessary to provide the Service. This permission does not transfer ownership or intellectual property rights in input data to us.

If submitted planning data or similar information is to be used for AI training or the creation of training datasets, separate consent will be obtained under the “Data Use Consent for AI Training and Quality Improvement.” Agreement to these Terms alone will not be treated as consent to AI training.

Do not enter third-party information that you are not authorized to submit or use, or information whose submission would breach legal or contractual restrictions. Before handling confidential information belonging to governments, clients or business partners, obtain the necessary approvals and confirm the handling conditions with us.

Article 7 — Intellectual property and external data

Rights in the Service’s programs, screen layouts, logos and similar materials belong to us or other legitimate rights holders.

Users may use output results for their own work, planning, research and similar purposes in accordance with these Terms and the conditions displayed within the Service. External providers’ conditions may apply to background maps, aerial photographs, elevation data and other materials. Do not remove source or copyright notices, and check the conditions for reproduction and distribution.

Use of the Service does not grant rights to resell external data or any other rights in that data.

Article 8 — Prohibited conduct

Users must not engage in the following:

• Violations of laws or third-party rights
• Unauthorized access, impersonation or misuse of authentication information
• Circumvention of usage limits, unauthorized data collection or imposing excessive load
• Interference with the normal operation of the Service
• Unauthorized acquisition or disclosure of our confidential information or that of third parties
• Presentation of analysis results as if they were guaranteed or certified by us or a public authority
• Other comparable misconduct

Article 9 — Changes, suspension and termination

We may change, suspend or discontinue the Service for maintenance, incident response, changes to external services, disasters or other reasonable grounds.

Except in emergencies, changes or discontinuation that materially affect users will be announced in advance. Users should also keep their own copies of necessary data and results.

Article 10 — Warranties and liability

We make reasonable efforts to improve quality and maintain stable operation, but do not guarantee the accuracy, completeness or currency of all analysis results, fitness for a particular purpose or continuous availability.

Whether we are liable to compensate users for losses, and the extent of any liability, will be determined by applicable law. These Terms do not exclude or limit liability for our intentional misconduct or gross negligence, or any other liability that cannot legally be excluded or limited.

Article 11 — Account closure and personal information

Users may request account closure by contacting our support contact.

The handling of personal information, retention and deletion after account closure, and requests for disclosure or similar matters are addressed separately in the Privacy Policy. Consent to AI training may be withdrawn without closing an account.

Article 12 — Changes to these Terms

We may amend these Terms in response to changes in laws or the Service, to the extent permitted by law.

Material changes and their effective dates will be announced in advance, and renewed consent will be obtained where required by law. Amending these Terms alone will not expand the scope of consent to AI training.

Article 13 — Governing law and dispute resolution

The law governing these Terms and the agreed court with jurisdiction over disputes are [to be confirmed in light of the contracting entity and service regions].

These Terms do not exclude protections under mandatory laws applicable to users.
